Intellectual property
Intellectual property is often the most valuable asset that a startup owns.
The most common forms of IP in the startup space are trademark, copyright and patents. You can register your ownership of trademark and patents. Copyright is a little bit different. Copyright is an automatic right attached to original pieces of literary or artistic work. There is no registration system or process for copyright protection in Australia.
A common issue amongst startups is the need to transfer intellectual property created by the founders to the business (company). This is achieved by way of an assignment of IP.
The other common requirement amongst startups is to licence technology to a third party, such as a customer. Getting the terms of a licence agreement are critical to ensure that you maintain your ownership and control over the intellectual property.
